These Terms of Use govern access to and use of Fashuki, including the website, mobile experiences, accounts, listings, messages, orders, payments, delivery features, reviews, and support services. By creating an account, listing an item, placing an order, or otherwise using Fashuki, you agree to these Terms and the policies incorporated into them.
Fashuki is operated by [INSERT FULL UAE LEGAL COMPANY NAME], [INSERT LEGAL FORM], licensed by [INSERT LICENSING AUTHORITY] under trade licence number [INSERT TRADE LICENCE NUMBER], with its registered office at [INSERT FULL REGISTERED OFFICE ADDRESS, EMIRATE, UAE]. You can contact us at hello@fashuki.com.
Fashuki is a fashion marketplace that enables private and business sellers to list permitted fashion items and enables buyers to purchase them. Unless Fashuki is expressly identified as the seller, the purchase contract is between the buyer and the seller named on the listing and order confirmation.
Fashuki provides marketplace technology, payment coordination, communication, moderation, and support. Fashuki does not guarantee that every user or item is genuine, lawful, safe, or accurately described. However, nothing in these Terms excludes responsibility or consumer rights that cannot lawfully be excluded, including any responsibility imposed on an electronic commerce platform under UAE law.
You must use Fashuki lawfully, honestly, and respectfully. You must not list prohibited items, infringe intellectual property, manipulate ratings, mislead users, move a transaction off platform to avoid fees or protections, scrape the service, introduce malware, interfere with security, impersonate another person, use another person’s payment method without authority, or misuse personal information.
A listing must be accurate, complete, in AED, supported by original photographs, and disclose the item’s brand, size, condition, defects, material, measurements, location, delivery arrangements, and seller type. Used, refurbished, altered, repaired, or defective condition must be stated prominently.
When a buyer places an order and payment is authorised, the seller must fulfil the order within the stated processing time. Fashuki may reject, cancel, or reverse a transaction where payment fails, the item is unavailable or prohibited, fraud is suspected, a legal obligation applies, or a material listing error exists.
Prices and charges are shown in United Arab Emirates dirhams. Applicable delivery charges, platform fees, taxes, and payment charges will be disclosed before the buyer confirms the order. Fashuki must not add an unannounced charge after confirmation.
The seller is responsible for setting an accurate price and for its taxes, registrations, invoices, records, and reporting obligations. Fashuki may collect or remit taxes where the law requires it.
Payments are processed through approved payment service providers. References to a seller balance are an accounting record of amounts processed in relation to completed transactions. They are not a bank account, deposit, stored value facility, or promise of interest. Fashuki does not describe or provide an escrow service unless this is expressly delivered by an appropriately licensed provider.
Seller proceeds become eligible for payout only after the conditions in the Payments, Fees, Seller Balance and Withdrawals Policy are met. We may delay or withhold payout to investigate disputes, chargebacks, fraud, legal requirements, sanctions, payment reversals, or account risk.
The seller must ship safely and on time using an approved trackable method. The buyer must provide an accurate delivery address, monitor delivery, and inspect the item promptly.
Returns, refunds, cancellations, damaged items, non delivery, counterfeit concerns, and not as described claims are handled under the Buyer Protection, Returns and Refunds Policy and applicable UAE law. A private seller may choose not to accept a discretionary change of mind return where the item is compliant and as described, but no policy limits mandatory rights for defective, damaged, counterfeit, incomplete, delayed, unlawful, or misdescribed goods. Business sellers must comply with all legal and advertised rights.
Reviews must reflect a genuine transaction and honest experience. We may display, moderate, reject, or remove reviews that are fake, abusive, irrelevant, incentivised without disclosure, unlawful, or disclose personal information. We will explain material moderation decisions where appropriate and maintain a reporting channel.
You retain ownership of content you create. You grant Fashuki a worldwide, non exclusive, royalty free licence to host, reproduce, adapt for formatting, translate, display, distribute, and promote that content for operating and marketing the marketplace while the content is live and for a reasonable archival period. You confirm that you have the rights needed to grant this licence.
Fashuki branding, software, design, text, and other platform materials are owned by or licensed to Fashuki. You may not copy or exploit them except as permitted by law or written permission.
We may remove content, limit features, hold transactions, suspend, or close an account where reasonably necessary to enforce these Terms, protect users, investigate risk, comply with law, or respond to a regulator, payment provider, rights holder, or court. Where appropriate, we will consider severity, frequency, evidence, user impact, and the possibility of correction. We may act immediately in urgent safety, fraud, legal, or security cases.
You may close your account subject to completing active orders, disputes, returns, chargebacks, withdrawals, and legal retention requirements. Terms that logically continue after closure remain in effect.
We may maintain, change, suspend, or discontinue features. We will use reasonable care but do not promise uninterrupted or error free availability. We may update these Terms for legal, security, operational, or service changes. Material changes will be notified in a clear manner before they take effect where required.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence where applicable, or mandatory consumer rights.
Subject to the previous sentence and to applicable law, Fashuki is not responsible for indirect or consequential loss, loss caused by a user’s unlawful conduct, or loss that was not reasonably foreseeable. [INSERT LEGALLY APPROVED LIABILITY CAP AND EXCEPTIONS].
These Terms are governed by the federal laws of the United Arab Emirates and the applicable laws of [INSERT EMIRATE]. The competent courts of [INSERT EMIRATE], United Arab Emirates, have jurisdiction, subject to any mandatory consumer forum or jurisdiction.
Contact hello@fashuki.com first so we can try to resolve a concern. Nothing prevents a consumer from using a competent UAE consumer protection authority or court.
Questions about these Terms may be sent to hello@fashuki.com or by post to [INSERT REGISTERED OFFICE ADDRESS].
